Question 1:
This program will create the document indicated. Please be sure
that this is what you want to write before starting. You can
return to the main menu and select another module by pressing the
"escape" (Esc) key.
A Maintenance Agreement, as you have selected, is used as a
contract between a customer or owner of equipment or personal
property, and a contractor or someone who is to be responsible for
keeping the equipment or property in good working order.
Question 2:
Please enter the full name of the customer (the person or company
requesting maintenance of the property). This can be either an
individual or a company name.
Question 3:
Please enter the full name of the contractor (the person or company
performing the work). This can be either an individual or a
company name.

The program allows great flexibility in specifying what the
contractor is going to do and when he or she is going to work.
If a certain number of hours are required, then answer "yes" to
this question.

Here, you can specify the exact number of hours that the
contractor will work.
Question 6:
Often in an agreement like this one, you will want to specify
that the contractor is to maintain the property or equipment on a
regular basis: such as "every week", "every month" etc. Here,
put the number of days between each visit: for example "7", "30",
etc.
Question 7:
The program allows you to designate six separate pieces of
property or equipment that the contractor will be responsible to
maintain. This question allows you to designate the first item.

You can specify how long this agreement will last. One common
way to do that is to designate a certain number of months. You
will have an opportunity later to designate that the agreement
will continue for a certain number of years.

Here, you need to put in the exact number of months that the
agreement will continue.

Question 22:
Will the contractor receive payment for maintaining the property?
Answer "no" to this question if the maintenance of the property
is included in a prior sales agreement, or if the only payment
that the contractor will receive is for parts for the equipment.
Question 23:
If there is to be a fee, you need to designate when it will be
paid. Thus, if there is to be a fee then this question should be
answered "yes". You will have the opportunity later to specify
that the fee will be paid by the hour.
Question 24:
Here, please enter how much a month the contractor will receive.
You needn't put a "$" sign because it will automatically appear
in the document.
Question 25:
If there is to be a fee, will it be paid by the hour?
Question 26:
Please designate what the hourly amount will be. You needn't put
a "$" sign because it will automatically appear in the document.
Question 27:
There will often be extra parts required to properly keep the
equipment of property maintained. Who will be responsible to pay
for those items?
Question 28:
When the contractor will buy parts that the customer will pay for,
it is appropriate that the contractor not simply purchase the parts
without getting the customer's consent when the expense involved
reaches a certain limit.
Question 29:
Here, you can specify how much the contractor can spend on parts
without first getting the consent of the customer. You needn't
put a "$" sign because it will automatically appear in the
document.
Question 30:
It is important to identify how the agreement can be terminated.
Answering "yes" to this question will allow the customer to end
the arrangement simply be notifying the contractor. Keep in mind
that all agreements can end by both parties agreeing to end it.
Question 31:
If the customer can end the agreement by giving notice to the
contractor, how many days notice is required? This can be "7",
"10", "30" or whatever you wish to designate.
Question 32:
It is often cheaper to arbitrate a dispute than to go to court to
resolve it. This clause allows you to specify that any problem
must be arbitrated rather than litigated in court. Arbitration
is available in all of the major cities in the United States and
in many rural areas, although before using this clause you might
check with an attorney in your area to make sure that some form
of arbitration is available.
Question 33:
In many states it is necessary to have a clause like this in a
contract to enable the prevailing party in a dispute to be
reimbursed for attorneys' fees. The cost of legal help is
becoming such that if you can't get fees from the other side if
the agreement is breached, then it could be too expensive to
proceed against them to enforce your rights. Thus, this kind of
clause is often a very good idea. If you are not sure that you
can get fees in your state or territory without this clause, then
it is recommended.
Question 34:
The city or town that the agreement will be signed in needs
to be specified. If you are going to execute the agreement in a
rural area (not in a city or town) then use the name of the
closest city or town.
Question 35:
The state, territory or jurisdiction needs to be specified.
Question 36:
The questions are now complete. You can go back to any question
if you wish by pressing "escape", or you can continue with the
program. Now that the questions are completed, the program will
allow you to preview the document, write it to a disk file for
editing further or print it. Note that it will be automatically
saved so you can review or print it later.
